1. Who this policy covers
GroundMark Realty (“GroundMark,” “we,” “us”) provides this property-information website. This policy covers information collected through the website and follow-up concerning requests made here. Patriots in Action (PIA) provides website administration and technical support for GroundMark; authorized PIA administrators may access inquiry information to operate and support the service.
This policy does not govern an independent resident/owner portal, an external brokerage or lender, a signed transaction agreement, or a website you visit through an external link. Their own terms and notices apply. Our public property categories are Land, Commercial and Multi-Family; residential rental listings are currently unavailable.
2. Information we collect
Inquiries: your name, email address, optional phone number, message, the property you ask about, submission time, follow-up status, and the contact choices and policy acknowledgments recorded with your request. We may retain subsequent correspondence and notes needed to answer it. You choose what to include; please provide only information relevant to the inquiry.
Staff accounts: administrator email, a protected password representation, session identifiers, listing edits and activity records. Property staff may upload listing descriptions, photographs and related business details. Public listing information is intended to be displayed; private inquiries are not.
Technical information: hosting and security services may process IP addresses, request URLs, timestamps, browser/device details, response codes and diagnostic information. Inquiry delivery records contain intended staff recipients, message identifiers and delivery results. We do not request your device’s precise location; map markers describe properties.
Browser features: saved property IDs stay in your browser’s local storage, while search filters appear in page URLs. Calculator inputs are calculated in your browser and are not submitted as a loan application or stored as inquiry details unless you choose to include them in a message.
3. How we use information
We use information to answer inquiries, provide requested property details, arrange appointments, follow up through your chosen channels, maintain listings and accounts, operate and secure the site, prevent abuse, troubleshoot delivery, keep consent and preference records, and comply with legal obligations or resolve disputes. We may use non-identifying operational totals to understand whether the service is working.
We do not make lending, tenancy, credit, insurance or other legally significant eligibility decisions through this website. We do not use inquiry data to infer sensitive traits or enroll visitors in unrelated campaigns.
4. Email, calls and text messages
Submitting an inquiry requests an email response about that inquiry. Providing a phone number alone does not authorize text messages. The form offers separate, optional choices for a phone call and for texts about the inquiry, property details or appointments. Neither choice is preselected, and neither is required to submit an inquiry or purchase services. The record of your choice includes the notice version and submission time.
Our present communications are individual inquiry follow-up, not a marketing subscription. We do not operate an automated promotional texting, prerecorded-call or artificial-voice campaign through this site. An inquiry, a site visit or acceptance of these policies is not consent to such campaigns. Any later marketing or automated communications requiring additional permission would need a separate opt-in.
Ask the responding person to stop, reply STOP or another clear stop request to a text, or contact dan@groundmarkrealty.com, by calling (806) 373-8333, or by writing to GroundMark Realty, Attn: Privacy, 1000 S Jefferson St, Amarillo, TX 79101. For text assistance, reply HELP or contact the office. Message frequency depends on your inquiry; carrier message and data rates may apply. Text delivery is not guaranteed, and messaging is not an emergency service. We honor reasonable withdrawal requests promptly, subject to applicable law. A necessary non-promotional confirmation or legally required notice may still be sent. Tell us which channels you wish to stop; if your request is unclear, we will clarify rather than treat it as permission to continue optional contact.
We do not record calls through this website. If recording is proposed in a future workflow, we will provide the notice and obtain the permission required before recording. If commercial email subscriptions are later offered, those messages will identify the sender, include a valid mailing address and a clear opt-out, and honor opt-outs within the applicable period, no later than 10 business days where CAN-SPAM applies.
6. Cookies, saved properties and browser choices
A necessary administrator-session cookie, groundmark_session, supports staff sign-in and has a configured 12-hour lifetime. It is not an advertising cookie. Public browsing does not require a visitor account. The groundmark-saved local-storage entry retains property IDs selected with the save button until you remove them or clear browser storage. Clearing this data resets the shortlist; it does not delete inquiries already submitted.
You may block or clear cookies and local storage using your browser settings, although staff sign-in or saved-property features may stop working. We do not currently perform sale, targeted advertising or significant-decision profiling, so a Global Privacy Control or similar opt-out signal has no such processing to disable. We will honor legally required signals if relevant processing is introduced. A browser “Do Not Track” setting is not a substitute for contacting us about information already submitted.
7. Google Analytics and future tracking
Google Analytics is not currently installed or active on this website. There are no advertising pixels, remarketing tags, or session-replay tools in the current site. Visiting or submitting a form does not give blanket consent to future tracking.
If Google Analytics is introduced, we will first update the disclosures to describe the active configuration, purposes, data categories, retention and choices, and implement consent or opt-out controls where required. Analytics may use browser identifiers and cookies to measure page visits, device/browser characteristics, interactions, referral information and approximate location. Advertising features or cross-site targeting would require a separate assessment and disclosure. We will not put names, email addresses, phone numbers, free-text form contents, private records, or sensitive information into analytics events, page URLs or identifiers.
For general information about Google’s processing and browser tools, see How Google uses information from sites and apps and the Google Analytics opt-out browser add-on. Those links are informational; they do not mean Analytics is enabled here. An add-on is not a substitute for any consent controls we must provide.
8. Maps, portals and external websites
Interactive maps request tiles from OpenStreetMap infrastructure. Those requests can disclose your IP address, browser/referrer information and the map area requested to the tile provider. See the OpenStreetMap Foundation Privacy Policy. We do not transmit inquiry-form contents to map providers.
Google Maps direction links open Google only when selected. Resident and owner portal links open independently operated AppFolio services. External property resources and the future County Post rental service have their own policies; we do not automatically transfer your GroundMark inquiry to them merely because a link is displayed. Review their notices before providing information.
9. How long we keep information
We retain inquiry and correspondence records while needed to respond, maintain a relevant client relationship, document transactions or permissions, meet applicable recordkeeping obligations, resolve disputes and protect the service. Retention depends on the type of record, its purpose and legal requirements; not every inquiry has the same deletion date. We review records for deletion or de-identification when those needs end.
Limited opt-out or suppression records may be kept to prevent unwanted future contact. Routine backups and delivery/security logs have their own retention cycles; information removed from active records may remain in restricted backups until those copies expire, and may be retained longer for a legal hold. Privacy requests also need to address authorized staff mailbox copies where appropriate. Browser-saved properties can be cleared directly by you.
10. Your privacy choices and requests
Request access to or a copy of your information, correction, deletion, withdrawal of optional consent, or removal of a public display by contacting dan@groundmarkrealty.com, by calling (806) 373-8333, or by writing to GroundMark Realty, Attn: Privacy, 1000 S Jefferson St, Amarillo, TX 79101. Describe the request and the email address used with this site. You do not need a new account. We may ask for proportionate information to verify your identity or an authorized agent’s authority; do not send identity documents or sensitive records unless we arrange a secure method. We will not discriminate against you for exercising applicable privacy rights.
Depending on applicable law and its scope, you may also have rights to portable data and to opt out of sale, targeted advertising, or profiling used for legally significant decisions. This site does not currently engage in those activities. Texas law has applicability conditions and exemptions; this notice does not limit rights that otherwise apply.
Where the Texas Data Privacy and Security Act applies, we respond within 45 days, with one additional 45-day period when permitted and explained within the initial period. If we decline a request, we explain why and how to appeal. Send an appeal to the same contact with “Privacy appeal” in the subject; applicable Texas appeals receive a written response within 60 days. You may also use the Texas Attorney General’s privacy complaint resources. Other applicable deadlines or remedies remain available. We may retain information required by law or reasonably necessary for fraud prevention, security, disputes, or honoring your preferences, and will explain relevant limits.
11. Security and international access
We use reasonable administrative and technical safeguards, including encrypted connections, restricted staff access and protected cloud storage. No website, email service or transmission can be guaranteed completely secure. Use a trusted device and avoid sending passwords, financial-account credentials, Social Security numbers, health information or other unnecessary sensitive details through ordinary forms or email.
The site is operated for a United States audience and uses United States cloud infrastructure. Service providers may process limited technical information elsewhere under their own arrangements. Access from another country may involve international transfers; visiting alone is not consent to waive protections that applicable law requires. Where another jurisdiction’s rules apply, additional disclosures or safeguards may be required.
12. Children and eligibility
GroundMark is intended for adults. Please do not submit personal information if you are under 18. We do not knowingly solicit personal information from children under 13. A parent or guardian who believes a child supplied information can contact us so we can investigate and remove it as appropriate. We do not knowingly sell or use children’s data for targeted advertising.
13. Changes to this policy
We will revise this page and its effective date when our practices change. Material changes may receive an additional notice on the site or through an appropriate contact method. A policy update does not retroactively create permission to publish private information, send marketing texts, or introduce tracking that requires consent. We will obtain new permission when required.
14. Contact GroundMark about privacy
For privacy requests, communication preferences, accessibility help or questions about this policy, contact dan@groundmarkrealty.com, by calling (806) 373-8333, or by writing to GroundMark Realty, Attn: Privacy, 1000 S Jefferson St, Amarillo, TX 79101. Read our Terms of Service for website-use and communication conditions.
