1. About these terms
These Terms govern use of the GroundMark Realty website and its property browsing, calculators, saved-property features and inquiry forms. “GroundMark,” “we” and “us” refer to GroundMark Realty in connection with this website. Please read these Terms and the Privacy Policy. If you do not agree to the conditions applicable to an interactive service, do not submit information through that service.
Submitting an inquiry requires an affirmative acknowledgment of these Terms and the Privacy Policy. This does not create a brokerage contract, authorize marketing calls or texts, or waive rights that cannot lawfully be waived. Separate signed agreements govern an actual engagement or transaction and control over conflicting website provisions for that transaction.
2. Eligibility and accurate information
You must be at least 18 to submit inquiries or use a staff account. Submit your own accurate contact details or act with authority for the person or business you represent. Do not use another person’s phone number or email without authority. Tell us if a contact number changes or is reassigned. Information you submit should be relevant to your request and should not include unnecessary sensitive information.
3. Property information and preview listings
Listings, prices, availability, acreage, square footage, zoning descriptions, financial figures, photographs and map locations may change or contain errors. A listing is an invitation to inquire, not an offer that you can accept through this website. We may correct, update, withdraw or archive a listing without notice. Availability and all material facts must be confirmed with an authorized representative.
Listings labeled “sample,” “fictional” or “illustrative” are for demonstrating the site and are not representations that a property is genuinely offered on those terms. Illustrative photos do not establish the condition or identity of a real property. Maps and boundaries are approximate and are not surveys, legal descriptions, title opinions or assurances about access, utilities, environmental condition, development approval or permitted uses.
Residential rental listings are currently unavailable. The County Post coming-soon notice does not create a rental application, waitlist, reservation or promise of a launch date.
4. No agency, financing or transaction through browsing
Browsing, saving a property, requesting information or using a calculator does not establish an agency, fiduciary, broker-client, lender-borrower, landlord-tenant or other professional relationship. It does not reserve property, make an offer, obligate a seller or landlord, or create a commission or fee agreement. Written agreements and legally required brokerage disclosures govern any actual relationship.
Obtain appropriate legal, tax, financial, lending, environmental, engineering, survey and real estate advice for a contemplated transaction. Website information is general information, not personalized professional advice. GroundMark does not accept deposits, rent, closing funds or loan applications through this site.
5. Calculators and investment estimates
Calculations depend on the values and assumptions entered and may be rounded. Payments, loan balances, capitalization rates, cash-on-cash returns, lease costs and coverage ratios are estimates, not financing commitments, appraisals or promises of investment performance. Results may exclude taxes, insurance, vacancies, reserves, maintenance, commissions, transaction costs, changing rates and other material items. Verify assumptions and calculations independently before acting.
6. Inquiries and responses
An inquiry is saved for staff review and queued for notification. A submission confirmation does not guarantee immediate receipt, a reply within a particular time, an appointment or property availability. Delivery can be delayed or filtered. For time-sensitive matters, call the published office number. Do not use the website for emergency notices, legal service of process, deadlines or binding transaction instructions.
You retain rights in your inquiry content and authorize GroundMark and necessary service providers to use it to handle the inquiry and operate the service, as described in the Privacy Policy. This is not a license to publish your private message as advertising. Authorized listing staff must have rights to submitted photos and descriptions.
7. Email, phone and SMS conditions
Submitting an inquiry requests an email response about it. Calls and texts are optional and limited to the channels you select or separately request. The text choice covers individual responses about your inquiry, related property details and appointments, not a general promotional subscription. Consent is not a condition of purchasing property or services. Supplying a number or agreeing to these Terms alone is not text-message consent.
Message frequency varies with the conversation; message and data rates may apply. Reply STOP or otherwise clearly ask to end text contact, reply HELP for help, or contact dan@groundmarkrealty.com, by calling (806) 373-8333, or by writing to GroundMark Realty, Attn: Privacy, 1000 S Jefferson St, Amarillo, TX 79101. You can withdraw call or text permission by a reasonable method. We will honor withdrawal requests promptly as required by law. You may receive a permitted non-promotional opt-out confirmation. Carriers and delivery services are not responsible for delayed or undelivered messages. You are responsible for carrier charges under your plan.
We do not currently use this site to enroll users in automated marketing texts, prerecorded or artificial-voice calls, or mailing-list campaigns. Such a program would require its own appropriate disclosures and permissions before use. Communication consent records describe the original choice; a later withdrawal controls. Call recording is not part of the present website service.
8. Acceptable use
Do not impersonate another person; submit fraudulent inquiries; send threats, harassment, discriminatory material or unlawful content; probe or bypass access controls; introduce malware; interfere with availability; misuse contact details; submit unauthorized bulk messages; or collect private data from the service. Do not scrape, reproduce or commercialize listing content in violation of applicable rights or technical restrictions. Lawful accessibility tools, personal browsing and authorized search indexing are not prohibited merely because they use software.
9. Staff accounts and submitted materials
Staff accounts are for authorized personnel. Protect credentials, use only assigned access, and report suspected misuse promptly. We may suspend unauthorized access or remove material that violates these Terms, applicable law or others’ rights. Uploaded listing material must be accurate to your knowledge and authorized for publication. Draft or archived status is a publication setting, not permission to upload confidential or unlawful material.
10. Content and intellectual property
GroundMark branding, original site content and software are protected by applicable intellectual-property law; third-party photos, maps, trademarks and source materials remain subject to their owners’ rights and licenses. You may view and print reasonable portions for personal evaluation of properties. No ownership or broader commercial-use license is transferred. Contact us with a specific description and location of material you believe infringes your rights.
11. External services and links
External map, resident/owner portal, financing, property-resource and County Post links are provided for convenience. We do not control their availability, terms or data practices. A link does not make GroundMark responsible for an independent service or guarantee its content. Review that provider’s terms before providing information or paying money.
Verify any payment or wire instructions independently using a previously trusted telephone number. Do not rely on unexpected email, text messages or changed payment instructions. This website is not a payment-processing or escrow service.
12. Fair housing and accessibility
GroundMark’s services and website must be used consistently with applicable fair housing, civil rights and nondiscrimination laws. Do not request or post unlawful discriminatory preferences. The site does not screen tenants or determine creditworthiness. If you need help accessing information or an accommodation in communicating with us, contact the office and describe the assistance needed.
13. Availability, warranties and responsibility
To the extent permitted by law, the website and general informational tools are provided as available without a guarantee of uninterrupted, error-free operation, absolute security, or fitness for a particular investment decision. We remain responsible for duties and representations that applicable law or a signed agreement does not allow us to disclaim.
To the extent permitted by law, GroundMark is not liable for indirect, incidental, special or consequential losses arising from use of the website, such as speculative investment returns or losses caused solely by an independent service. These limitations do not exclude liability for fraud, willful misconduct, gross negligence, personal injury or any liability that cannot lawfully be excluded. Nothing here limits non-waivable consumer protections or a remedy available under applicable law.
14. Applicable law and disputes
Texas law governs these website Terms to the extent consistent with mandatory laws that apply to you. Contact GroundMark first if you would like to try to resolve a concern informally; this is not a prerequisite that shortens a statutory deadline or restricts a complaint to a regulator. Any court proceeding must be brought in a court with lawful jurisdiction. These Terms do not impose mandatory arbitration, a class-action waiver, or waiver of non-waivable privacy or consumer rights.
15. Updates and other provisions
We may update these Terms prospectively and display the effective date. Material changes will receive appropriate notice, and additional agreement will be requested when required. New terms do not retroactively change an existing signed transaction or communication consent. If a provision is unenforceable, the remaining provisions apply to the extent lawful. A failure to enforce a provision immediately does not waive it. We may discontinue features while preserving legally required obligations.
16. Contact and related notices
Contact dan@groundmarkrealty.com, by calling (806) 373-8333, or by writing to GroundMark Realty, Attn: Privacy, 1000 S Jefferson St, Amarillo, TX 79101 for questions, accessibility assistance, complaints or communication preferences. Our Privacy Policy explains data use and rights. Brokerage-specific disclosures and any signed agreement remain separate from these website Terms. The Texas Real Estate Commission Consumer Protection Notice explains available consumer resources.
